1. AGREEMENT

This Agreement is entered into by and between Creative Climates LLC ("Company," "we," "us," or "our") and you ("Client") for the purpose of providing residential energy audit services as described in our service offerings.

2. DESCRIPTION OF SERVICES

Creative Climates LLC provides professional residential energy audits and efficiency assessments in Queens, NY. Our audits include:

  • Comprehensive home energy evaluation

  • Identification of energy loss and inefficiency

  • Recommendations for improvements and available rebates/incentives

3. CLIENT RESPONSIBILITY

A. Independent Decision-Making
You are solely responsible for all decisions made regarding energy improvements, contractors selected, and actions taken based on our audit recommendations. Creative Climates LLC does not guarantee specific savings or outcomes.

B. Not a Substitute for Professional Services
Our audit is an assessment only. If you need architectural, engineering, or construction advice, you are responsible for consulting appropriate licensed professionals.

C. Implementation
You are responsible for implementing any recommendations at your own discretion and expense. We do not perform the work recommended in our audit.

4. SERVICE TERMS

A. Audit Scope
The scope of each audit is determined at the time of scheduling and may be adjusted based on your home's access and condition.

B. Communication
We will communicate via email, phone, or text as needed. Response times are typically within 24 business hours.

C. Cancellation
You may cancel a scheduled audit up to 48 hours in advance. Cancellations within 48 hours may be subject to a cancellation fee.

D. No Refunds
Once service is rendered and payment is received, no refunds will be issued.

5. CONFIDENTIALITY

We agree to keep your personal and home information confidential and will not share it with third parties without your consent, except as required by law.

6. LIABILITY LIMITATION

Creative Climates LLC makes no guarantees regarding energy savings or specific outcomes from implementing audit recommendations. To the maximum extent permitted by law, our liability is limited to the amount you paid for the audit services. We are not liable for any indirect, consequential, or special damages.

7. INDEPENDENT PROFESSIONAL ADVICE

You acknowledge that:

  • An energy audit is an assessment, not a guarantee

  • You should consult licensed contractors, engineers, or other professionals as needed

  • You are responsible for verifying all recommendations before implementing changes

8. TERMINATION

You may terminate this agreement at any time. If you terminate before the audit is completed, you will be responsible for payment for services rendered to that point.

9. ENTIRE AGREEMENT

This Agreement represents the entire understanding between you and Creative Climates LLC regarding our services. It may only be modified in writing and signed by both parties.

10. DISPUTE RESOLUTION

If a dispute arises, both parties agree to attempt good-faith resolution through direct communication. If unresolved after 30 days, either party may pursue legal action. The prevailing party in any legal action shall be entitled to recover reasonable attorney's fees and court costs.

11. GOVERNING LAW

This Agreement shall be governed by the laws of the State of New York without regard to conflicts of law principles.
